PROPOSED REGULATION ON RESTRICTIONS FOR SUBSTANCES USED IN FOOD CONTACT MATERIALS AND ARTICLES

Article 5 of Regulation 1935/2004/EC prescribes that food contact materials and articles have to be addressed through specific measures.

For example plastic materials and articles shall comply with Directive 2002/72/EC. However a specific measure has not been developed for all the materials and articles falling in the scope of 1935/2004/EC, therefore the proposed Regulation is aimed at covering some urgent needs for these materials and articles not yet covered.

In particular the said proposed Regulation addresses the use of plasticizers in contact with fatty, non-fatty and baby food. The following points shall be highlighted:

  • Esters of Phthalic Acid (Diethyl hexil DEHP, Diisononyl DINP, Diisodecyl DIDP, Dibutyl DBP, Benzylbutyl BBP) are not allowed as plasticizers in materials and articles in contact with fatty food;
  • The same Esters are not allowed in articles sealed by lids containing plasticized PVC gaskets used for materials and articles for infant formulae and follow-on formulae;
  • The same Esters are allowed as plasticizers in materials and articles intended to be used in contact with non-fatty food, with various SML derived by the safety assessment recently carried out by EFSA;
  • Epoxidized Soybean Oil is allowed with a specific migration limit of 30 mg/kg of food when used for materials and articles for infant formulae and follow-on formulae;
  • Epoxidized Soybean Oil is allowed in any other material or article in contact with fatty or non-fatty food, submitted to the overall migration limit of 60 mg/kg of food.
